Welcome to Quest, an AI-assisted dating and connection platform operated by Quest App, Inc., a Delaware corporation ("Quest," "we," "our," or "us"). These Terms of Service ("Terms" or "Agreement") govern your access to and use of our website, mobile application, beta features, AI-powered tools, and all related services (collectively, the "Services"). By accessing or using any part of the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not access or use Quest.

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. EXCEPT WHERE PROHIBITED BY LAW OR WHERE YOU OPT OUT AS DESCRIBED IN SECTION 17 BELOW, YOU AGREE TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION, WHICH MEANS YOU WAIVE ANY RIGHT TO HAVE THOSE DISPUTES DECIDED BY A JUDGE OR JURY, AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.

1. Who We Are

Quest is an AI-assisted dating app focused on curiosity, play, and real connection. Our platform uses artificial intelligence, including our AI matchmaker "Rumi," to help facilitate meaningful interactions between users. Quest App, Inc. is incorporated in the State of Delaware and operates in the United States.

Quest is currently in beta. Our Services, features, and functionality are subject to change at any time as we continue to develop and refine the platform.

2. Eligibility

To use Quest, you must:

• Be at least 18 years of age
• Be legally able to enter into a binding contract with Quest App, Inc.
• Not be prohibited from using the Services under applicable law
• Not have been convicted of or plead no contest to a felony, a sex crime, or any crime involving violence or threats of violence, unless you have been pardoned for such offense
• Not be required to register as a sex offender in any jurisdiction
• Not have any other active accounts on Quest
• Use the Services for personal, non-commercial purposes only

By using Quest, you represent and warrant that you meet all of these eligibility requirements. If you do not meet these requirements, you must not access or use the Services.

3. Pre-Launch / Beta Disclaimer

Our Services are currently experimental and in beta. You acknowledge and agree that:

• The Services may change, break, or become unavailable at any time without prior notice
• Features shown on the website, in marketing materials, or described in communications may not represent the final product
• We may add, modify, or remove features, functionality, or content at our sole discretion
• Data collected during the beta period may be deleted or reset
• The beta version may contain bugs, errors, or other issues that could affect your experience

We reserve the right to modify, suspend, or discontinue any part of the Services at any time. Your continued use of the Services after changes are made constitutes acceptance of those changes.

4. Your Account

When you create an account on Quest, you agree to the following:

• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account
• You will provide accurate, current, and complete information during registration and keep your profile information up to date
• You will not impersonate any other person or use a false identity
• You will not create more than one account per person
• You will not share your account credentials with any third party

You agree to notify us immediately at support@thequestapp.co if you suspect any unauthorized use of your account or any other breach of security.

Quest reserves the right to suspend, disable, or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

5. AI Features and Rumi Disclaimer

PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS IMPORTANT LIMITATIONS REGARDING OUR AI FEATURES.

Quest incorporates artificial intelligence features throughout the platform, including our AI matchmaker, "Rumi." By using Quest, you acknowledge and agree to the following:

5.1 Rumi Is Not a Licensed Professional

Rumi is an artificial intelligence tool. Rumi is NOT a licensed therapist, counselor, psychologist, psychiatrist, social worker, life coach, relationship coach, medical professional, or any other type of licensed or certified professional. Rumi does not provide professional advice of any kind. Nothing that Rumi communicates should be interpreted as professional guidance, diagnosis, or treatment.

5.2 Entertainment and Informational Purposes Only

All advice, suggestions, recommendations, insights, and other output generated by Rumi or any other AI feature within Quest (collectively, "AI Output") is provided strictly for entertainment and informational purposes only. AI Output should not be treated as a substitute for professional advice, including but not limited to medical, legal, financial, psychological, or safety-related guidance.

5.3 User Responsibility

You are solely responsible for any decisions you make or actions you take based on AI Output. Quest App, Inc. assumes no responsibility or liability for any consequences arising from your reliance on AI Output, including but not limited to personal, emotional, physical, financial, or relational outcomes.

5.4 Accuracy and Appropriateness

AI technology is inherently imperfect. AI Output may be inaccurate, incomplete, misleading, biased, or inappropriate. Quest does not warrant or guarantee the accuracy, reliability, completeness, or appropriateness of any AI Output. You should independently verify any information provided by AI features before relying on it.

5.5 Safety for In-Person Meetings

AI Output should NOT be relied upon to determine whether it is safe to meet another user in person. Rumi cannot verify the identity, intentions, background, or character of any user. Any decision to meet another user offline is made entirely at your own risk. Please refer to Section 9 (Safety & Meeting In Person) for important safety information.

5.6 Evolving Legal Landscape

Laws and regulations governing artificial intelligence are rapidly evolving. Quest App, Inc. does not guarantee that its AI features, including Rumi, comply with all current or future laws, regulations, or guidelines applicable to AI systems. We will make reasonable efforts to adapt our Services to applicable legal requirements, but we cannot guarantee full compliance at all times.

6. User Content & License

6.1 Ownership

You retain ownership of all content you submit, post, upload, or otherwise make available through the Services ("User Content"), including but not limited to photos, text, profile information, prompts, responses, and other materials.

6.2 License Grant to Quest

By submitting User Content to Quest, you grant Quest App, Inc. a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your User Content in connection with operating, improving, and personalizing the Services, including processing your conversations through AI systems to provide personalized responses and, with anonymized and aggregated data, to train and improve Quest's own AI models.

6.3 Personalization and Model Training

Rumi uses your conversation history to personalize your experience in real-time. This personalization is a core part of the Services. Separately, anonymized and aggregated conversation data may be used to train and improve Quest's own AI models. You may opt out of having your data used for model training at any time via your app settings or by contacting us at support@thequestapp.co. Opting out will not affect your ability to use the Services or Rumi's real-time personalization.

6.4 Private Conversations Between Users

Private one-on-one chat messages between users are encrypted in transit and at rest and are NOT used for AI model training or any other purpose beyond delivering them to the intended recipient. Quest does not read the content of private user-to-user messages. Only metadata associated with private chats — such as message count, timing, and delivery status — is accessible to Quest for purposes of operating and improving the Services. The content of your private conversations remains private.

6.5 Explicitly Shared Content

If you explicitly share content through designated in-app sharing features (such as sharing a conversation excerpt, a match story, or other content through a feature specifically designed for sharing), that shared content may be used by Quest in accordance with the license granted in Section 6.2. You will be clearly notified before any such sharing occurs.

6.6 Your Representations

You represent and warrant that:

• You own or have the necessary rights and permissions to submit your User Content
• Your User Content does not infringe, misappropriate, or violate any third party's intellectual property, privacy, or other rights
• Your User Content complies with these Terms, our Acceptable Use Policy, and all applicable laws

7. Acceptable Use

Your use of Quest is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree to comply with the Acceptable Use Policy in full.

Without limiting the Acceptable Use Policy, you agree that you will not use the Services to:

• Engage in any illegal activity or encourage illegal conduct
• Harass, bully, stalk, intimidate, threaten, or otherwise harm any person
• Impersonate any person or entity, or misrepresent your identity or affiliation
• Scrape, crawl, or use automated means to access the Services without our prior written consent
• Upload, share, or distribute sexually explicit, obscene, or pornographic content
• Distribute spam, unsolicited messages, or commercial solicitations
• Interfere with or disrupt the Services, servers, or networks connected to the Services
• Attempt to gain unauthorized access to any part of the Services or other users' accounts

Violation of the Acceptable Use Policy may result in suspension or termination of your account.

Content Moderation

Quest uses a combination of automated tools (including AI-based systems) and human review to monitor, detect, and enforce violations of these Terms, the Acceptable Use Policy, and Community Guidelines. We prioritize the most severe violations, including content involving child safety, terrorism, and threats of violence. Quest reserves the right to remove any content and suspend or terminate any account at its sole discretion, with or without notice, for any violation of our policies.

8. Community Guidelines

Quest is committed to fostering a respectful, inclusive, and safe community. Your use of the Services is subject to our Community Guidelines, which are incorporated into these Terms by reference. The Community Guidelines outline our expectations for user behavior, content standards, and community values. Violations of the Community Guidelines may result in content removal, account suspension, or permanent termination.

9. Safety & Meeting In Person

Quest strongly encourages all users to exercise caution when meeting other users in person.

Quest does NOT perform comprehensive background checks on its users. While we may offer optional identity verification features (see Section 10), these are not a substitute for your own due diligence and judgment.

Quest App, Inc. is not responsible for the conduct of any user, whether online or offline. You are solely responsible for your interactions with other users, including any in-person meetings. We recommend the following safety precautions:

• Meet in a public place for your first several meetings
• Tell a friend or family member about your plans, including where you are going and who you are meeting
• Arrange your own transportation to and from the meeting location
• Keep your phone charged and accessible
• Trust your instincts -- if something feels wrong, leave
• Do not share personal financial information with other users
• Report any suspicious or concerning behavior to Quest immediately

If you are in immediate danger, contact local law enforcement or emergency services (call 911 in the United States).

10. Identity Verification

Quest may offer optional identity verification through third-party verification services. If a user chooses to verify their identity, they will be asked to submit identification documents that are processed by a third-party verification provider.

A verification badge on a user's profile indicates that the user submitted an identification document that was reviewed and checked by a third-party verification service. You acknowledge and agree that a verification badge:

• Does NOT constitute a background check of any kind
• Does NOT guarantee the identity, character, intentions, or trustworthiness of the verified user
• Does NOT guarantee the safety of meeting the verified user in person
• Does NOT represent an endorsement or recommendation by Quest App, Inc.
• Is limited to confirming that a government-issued ID was submitted and checked by a third-party service at a point in time

Regardless of whether another user has a verification badge, you should always exercise your own judgment, take appropriate safety precautions, and independently assess whether you feel comfortable interacting with or meeting any other user.

11. Intellectual Property

All branding, logos, trademarks, service marks, trade names, designs, graphics, user interface elements, visual interfaces, code, software, text, images, videos, and other content on or within the Services (excluding User Content) are owned by or licensed to Quest App, Inc. and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not copy, modify, reproduce, distribute, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, or exploit any of Quest's intellectual property without our prior written consent, except as expressly permitted by these Terms or as required to use the Services as intended.

"Quest," "Rumi," the Quest logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Quest App, Inc. You may not use such marks without our prior written permission.

DMCA and Intellectual Property Infringement

Quest App, Inc. respects the intellectual property rights of others. If you believe that any content on the Services infringes your copyright or other intellectual property rights, please submit a notice of infringement to our designated agent at legal@thequestapp.co. Your notice should include: (a) a description of the copyrighted work or intellectual property you claim has been infringed; (b) a description of where the allegedly infringing material is located on the Services; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or authorized to act on the owner's behalf; and (f) your physical or electronic signature.

12. No Guarantees

Quest does not guarantee any specific outcomes from using the Services. Without limitation, Quest does not guarantee:

• Matches with other users
• Dates or in-person meetings
• Responses from other users
• Relationships, romantic or otherwise
• Any personal, emotional, social, or other outcome
• Compatibility with any particular user
• The accuracy or helpfulness of AI-generated suggestions or recommendations

Quest provides tools for connection, not promises of outcomes. Your experience will depend on many factors, including your own engagement and the engagement of other users.

13. Third-Party Services

The Services may integrate with, link to, or rely upon third-party services, including but not limited to analytics providers, cloud hosting services, AI and machine learning services, identity verification providers, payment processors, and communication platforms.

Quest App, Inc. is not responsible for the content, privacy practices, terms of service, or policies of any third-party service. Your use of third-party services is subject to their respective terms and conditions. We encourage you to review the terms and privacy policies of any third-party service you interact with through Quest.

Quest does not endorse, warrant, or assume liability for any third-party service, product, or content.

14. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QUEST APP, INC. EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, QUEST APP, INC. DOES NOT WARRANT THAT:

• THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE
• THE QUALITY OF THE SERVICES WILL MEET YOUR EXPECTATIONS
• ANY AI OUTPUT, INCLUDING OUTPUT FROM RUMI, WILL BE ACCURATE, COMPLETE, APPROPRIATE, SAFE, OR SUITABLE FOR ANY PARTICULAR PURPOSE
• ANY ERRORS OR DEFECTS IN THE SERVICES WILL BE CORRECTED
• THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

YOU USE THE SERVICES AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE, LOSS OF DATA, OR OTHER HARM THAT RESULTS FROM YOUR USE OF THE SERVICES.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUEST APP, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
• LOSS OF DATA, PROFITS, REVENUE, BUSINESS OPPORTUNITIES, OR GOODWILL
• PERSONAL OR EMOTIONAL HARM ARISING FROM YOUR USE OF THE SERVICES OR YOUR INTERACTIONS WITH OTHER USERS
• THE CONDUCT OF ANY USER, WHETHER ONLINE OR OFFLINE
• ANY RELIANCE ON AI OUTPUT, INCLUDING RECOMMENDATIONS OR SUGGESTIONS FROM RUMI

THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY (WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE), EVEN IF QUEST APP, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL QUEST APP, INC.'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) ONE HUNDRED U.S. DOLLARS ($100.00); OR (B) THE TOTAL AMOUNT YOU HAVE PAID TO QUEST APP, INC. IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, Quest App, Inc.'s liability shall be limited to the greatest extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Quest App, Inc., its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your User Content, including any claims that your User Content infringes or violates the rights of any third party
• Your use of, or inability to use, the Services
• Your violation of these Terms, including the Acceptable Use Policy and Community Guidelines
• Your violation of any rights of any third party, including intellectual property rights, privacy rights, or publicity rights
• Your violation of any applicable law, regulation, or ordinance
• Any dispute between you and another user of the Services

Quest App, Inc. reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any such matter without the prior written consent of Quest App, Inc.

17. Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

17.1 Agreement to Arbitrate

You and Quest App, Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or the relationship between you and Quest App, Inc. (collectively, "Disputes"), including the validity, enforceability, or scope of this arbitration agreement, shall be resolved exclusively through final and binding individual arbitration, rather than in court, except as set forth below. This arbitration agreement is governed by the Federal Arbitration Act ("FAA"), 9 U.S.C. § 1 et seq., and shall be interpreted and enforced in accordance with the FAA.

17.2 Informal Dispute Resolution

Before initiating arbitration, you and Quest App, Inc. agree to first attempt to resolve any Dispute informally. The party raising the Dispute must send a written notice describing the nature of the Dispute and the desired resolution to the other party. For notices to Quest, please send them to legal@thequestapp.co or by mail to Quest App, Inc., Attn: Legal Department. Both parties agree to meet and confer in good faith to attempt to resolve the Dispute within forty-five (45) days of receipt of the notice. If the Dispute is not resolved within this 45-day period, either party may proceed to arbitration as described below.

17.3 Arbitration Procedures

If a Dispute cannot be resolved informally, it shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under the AAA Consumer Arbitration Rules then in effect, as modified by this Section 17. The AAA Consumer Arbitration Rules are available at www.adr.org or by contacting the AAA. The arbitration will be conducted by a single neutral arbitrator. The arbitrator shall have exclusive authority to resolve all Disputes, including any question regarding the existence, scope, or validity of this arbitration agreement. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

17.4 Class Action Waiver

YOU AND QUEST APP, INC. AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, OR PRIVATE ATTORNEY GENERAL ACTION. UNLESS BOTH YOU AND QUEST APP, INC. AGREE OTHERWISE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PARTY'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING.

17.5 Jury Trial Waiver

YOU AND QUEST APP, INC. HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. You and Quest App, Inc. are instead electing that all Disputes shall be resolved by arbitration under this arbitration agreement. In the event that this arbitration agreement is found to be unenforceable for any reason, the jury trial waiver set forth in this Section 17.5 shall still apply.

17.6 Right to Opt Out

You have the right to opt out of this arbitration agreement. To opt out, you must send written notice of your decision to opt out within thirty (30) days of first becoming subject to this arbitration agreement. Your opt-out notice must be sent to: Quest App, Inc., Attn: Arbitration Opt-Out, or by email to legal@thequestapp.co with the subject line "Arbitration Opt-Out." Your notice must include your full name, the email address associated with your Quest account, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, all other provisions of these Terms will continue to apply to you. Opting out of the arbitration agreement will not affect your ability to use the Services.

17.7 Batch Arbitration

If one hundred (100) or more similar arbitration demands are filed against Quest App, Inc. within a 90-day period by or with the assistance of the same law firm, group of law firms, or organization, and the parties cannot resolve the Disputes within the informal dispute resolution period described in Section 17.2, the parties agree that the Disputes shall be resolved through batch arbitration. In batch arbitration, the AAA (or the parties' agreed-upon arbitration provider) shall: (a) group the similarly situated arbitration demands into batches of no more than 50 demands per batch; (b) assign each batch to a single arbitrator; and (c) apply the AAA Consumer Arbitration Rules to each batch. Each batch shall be treated as a single arbitration for purposes of fees and administration. The results of each batch shall apply only to the demands in that batch. This provision does not alter or waive the class action waiver in Section 17.4.

17.8 Exceptions to Arbitration

Notwithstanding the foregoing, nothing in this arbitration agreement shall prevent either party from:

• Seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights
• Filing an individual action in small claims court for Disputes within the jurisdiction of such court

18. Term and Termination

18.1 Term

This Agreement remains in effect for as long as you use the Services or maintain an account with Quest, unless terminated earlier in accordance with this Section 18.

18.2 Termination by Quest

Quest App, Inc. may terminate or suspend your account and access to the Services at any time, for any reason or no reason, with or without notice. Without limiting the foregoing, Quest may terminate your account for cause, including but not limited to: violation of these Terms, the Acceptable Use Policy, or the Community Guidelines; fraudulent, abusive, or unlawful activity; conduct that is harmful to other users, Quest, or third parties; or extended periods of inactivity.

18.3 Termination by You

You may terminate your account at any time by following the account deletion process within the app or by contacting us at support@thequestapp.co.

18.4 Effect of Termination

Upon termination of your account, for any reason:

• Your right to access and use the Services will immediately cease
• You will no longer have access to your account, profile, matches, messages, or other content associated with your account
• Quest may, but is not obligated to, delete your User Content and account data in accordance with our Privacy Policy

The following provisions shall survive termination: Sections 5 (AI Features and Rumi Disclaimer), 6.2 (License Grant to Quest), 11 (Intellectual Property), 14 (Disclaimers), 15 (Limitation of Liability), 16 (Indemnification), 17 (Arbitration Agreement), and 19 (General Provisions).

19. General Provisions

19.1 Electronic Communications Consent

By using the Services, you consent to receiving electronic communications from Quest App, Inc., including emails, push notifications, text messages (if you have opted in), and in-app messages. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

19.2 Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without the prior written consent of Quest App, Inc. Quest App, Inc. may freely assign or transfer these Terms, including in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets, without restriction and without notice to you.

19.3 Force Majeure

Quest App, Inc. shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, or cyberattacks.

19.4 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms, and all remaining provisions shall continue in full force and effect.

19.5 Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, Acceptable Use Policy, and Community Guidelines, constitute the entire agreement between you and Quest App, Inc. with respect to the Services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Services.

19.6 Governing Law

These Terms and any Dispute arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles, except to the extent preempted by the Federal Arbitration Act.

19.7 Exclusive Venue

For any litigation that is permitted to proceed outside of arbitration (as set forth in Section 17.8 or as otherwise determined), you and Quest App, Inc. agree to submit to the exclusive personal jurisdiction of the state and federal courts located in the State of Delaware. You and Quest App, Inc. waive any objection to jurisdiction and venue in such courts.

19.8 Waiver

The failure of Quest App, Inc. to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Quest App, Inc.

19.9 Changes to These Terms

We may revise these Terms from time to time at our sole discretion. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms and, where appropriate, by providing additional notice (such as an in-app notification or email). Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services and close your account.
